A Labour Market Impact Assessment (LMIA) is a document from Employment and Social Development Canada (ESDC) permitting you to hire a foreign worker when the skill or talent cannot be located within the Canadian labour market. It is the employer’s responsibility to apply for, and receive, a positive LMIA prior to hiring a foreign worker
Completing the LMIA takes time, knowledge, and expertise. A job must be posted in Canada for at least four weeks, and you must demonstrate that you were not able to find a Canadian or permanent resident for the position. Foreign workers can only receive a work permit once you have received a positive LMIA, so it is very important that you start the process well ahead of the intended start date for the position in question.
There are strict requirements that must be met both before receiving a positive LMIA and once the foreign worker is employed and working with you. ESDC and IRCC will conduct random compliance audits to ensure you are abiding by the terms of employment as set out in the LMIA application or LMIA exempt job offer
